Statutory Overview
Each County Board of Developmental Disabilities is comprised of seven members. The qualifications and appointment of board members are addressed in ORC Section 5126.029. Five members shall be appointed by the Board of County Commissioners, with at least two of those five being an immediate family member of an individual eligible for services by the Athens County Board of Developmental Disabilities (ACBDD). Whenever possible, the commissioners are to ensure one of those two is an immediate family member of an individual eligible for adult services, while the other is to be an immediate family member of an individual eligible for early intervention, pre-school or school-age services.
Two appointments are to be made by the senior probate judge, specifying one of those two is to be an immediate family member of an individual eligible for residential services or supported living. So, in total, at least three of the seven board members are to be family members of individuals eligible for county board services.
Qualifications of a County Board Member include:
- Resident of the County;
- Citizen of the United States;
- Interest and knowledge in the field of developmental disabilities and other allied fields;
- Professional training and/or experience in business management, finance, law, health care practice, personnel administration or government service; and,
- Membership of the board shall reflect, to the maximum extent possible, the composition of the county.
Appointment and Re-Appointment to the Board
Board members shall commence their four-year term in January on the date of the stated organizational meeting. Board members are eligible to serve three consecutive four-year terms. An individual appointed to complete the unexpired term of another board member may be appointed to three full terms following completion of the unexpired term, if the unexpired term is less than two years.
For a board member to be re-appointed, the individual must:
- Continue to meet the initial eligibility requirements;
- Served one or two four-year terms;
- If having served three consecutive four-year terms at one point, not served for at least the past two calendar years; and,
- If having served two consecutive four-year terms, not served more than two years of an unexpired term of another individual immediately prior to the two consecutive terms.
Board Meetings
The ACBDD is required to hold an organizational meeting not later than January 31 of each calendar year for the purpose of electing a President, Vice President and Secretary, as well as establishing its calendar or regular board meetings for the year. The Board is required to hold at least 10 regular board meetings per year.
Board Powers and Duties
ORC Section 5126.05 specifies the powers and duties of the Board itself. General responsibilities include, but are not limited to:
- Assess the facility and service needs of country residents with developmental disabilities
- Administer and operate facilities, programs and services
- Plan and set priorities based on available resources
- Develop an Annual Operating Plan
- Develop a three-year Home & Community Based Waiver Plan
- Monitor and evaluate existing services and facilities
- Ensure evaluation of service needs
- Complete the functions of service and support administration
- Employ the following personnel: Superintendent, Business Manager, Medicaid Services Manager, Investigative Agent
- Authorize all positions of employment
- Approve all management contracts that exceed one year in length
- Establish the compensation and benefit levels for all positions
- Adopt a budget
- Approve all board expenditure
